Access to Health Records of the Deceased

It is important to understand that Primary Care Contractors are contracted to deliver care to the living and not the deceased.  As such, when a registered patient dies and they are de-registered from a Practice, Primary Care Contractors are no longer at liberty to access and amend the medical record.  

Care of the medical record of the deceased is currently in the remit of Primary Care Support England.

The General Data Protection Regulation is only applicable to the living.
